Tax avoidance is the legal utilization of the tax regime to one's own advantage, to reduce the amount of tax that is payable by means that are within the law. By contrast, tax evasion is the general term for efforts to not pay taxes by illegal means. The term tax mitigation is a synonym for tax avoidance. Its original use was by tax advisors as an alternative to the pejorative term tax avoidance. Latterly the term has also been used in the tax regulations of some jurisdictions to distinguish tax avoidance foreseen by the legislators from tax avoidance which exploits loopholes in the law.

Some of those attempting not to pay tax believe that they have discovered interpretations of the law that show that they are not subject to being taxed: these individuals and groups are sometimes called tax protesters. An unsuccessful tax protestor has been attempting openly to evade tax, while a successful one avoids tax. Tax resistance is the declared refusal to pay a tax for conscientious reasons (because the resister does not want to support the government or some of its activities). Tax resisters typically do not take the position that the tax laws are themselves illegal or do not apply to them (as tax protesters do) and they are more concerned with not paying for particular government policies that they oppose.

A. tax planning is a course of action that minimises one's tax liability, but that is allowable under the cdn income tax act, e.g., rrsp contribution. CRA ok with that. tax avoidance is an arrangemment to circumvent certain tax provisions or object and spirit of the cdn tax act as a whole, e.g., foreign loss importation. CRA will challenge that using the anti avoidance rules in the act, e.g. sections 55, 84.1, and 245. tax evasion is simply not reporting income or inflating expenses thru phoney invoices, etc. CRA will assess interest on taxes owed, and apply penalties on these cases.

Tax avoidance Strategies?
Q. I plan on going into business soon. And from my projections, I could possibly make a lot of money. But let's say I made 1 million from my business, I don't believe that the Government should be entitled to $350,000 of my income money just because they exist and they want a cut. What are legal ways I can reduce the taxes I will have to pay? My cousin told me of a method: To make a separate business entity to put my income in. So when it comes time to pay taxes, the IRS will see your not making much of anything. And use your separate business entity for your income, and declare what you spend as a business expense. A. Relying on tax advise from your "cousin" may be a little risky. My guess is that he has no formal tax training. If you want to go into business you should consider getting advise from a tax professional.
